UK publican Nick Hogan was jailed for refusing to act as a law enforcement official in the face of the UK’s smoking ban.
Only weeks after being released from prison via donations from supporters, Mr. Hogan had no choice but to demand that a man who lit up inside his pub evacuate the premises. Mr. Hogan’s disgruntled patron then returned minutes later brandishing a carving knife, but was scared off by security staff.
This is precisely the kind of situation that opponents of smoking bans like Mr. Hogan have objected to all along; private business owners should not be put under forcible obligation to act as law enforcement officials.
